This is the English courtesy translation of our Terms of Use. The German original, AGB, is legally authoritative for users in Germany and governs in the event of any discrepancy.
These Terms of Use ("Terms") govern your use of the iOS app Yoga24 ("App"), provided by:
David Perez (miraiapps.de), Ettalstr. 9, 81377 Munich, Germany, email: info@miraiapps.de ("Provider," "we," "us")By downloading and using the App, you ("User," "you") accept these Terms. If you do not agree, please do not use the App. These Terms apply in addition to the App Store's usage rules and the Apple Media Services Terms and Conditions that govern your acquisition of the App through the App Store.
The App is intended for users aged 16 and older. Users under 16 may only use the App with the consent of a parent or legal guardian.
Yoga24 is an app for planning and running independent yoga practice: a pose catalog, curated and user-built routines, guided practice sessions with voice guidance, streak tracking, a Home Screen widget, and Live Activities.
The core app is free to use. An optional "Yoga24 Plus" subscription unlocks additional features. The exact feature set of each tier is described on the App Store product page and within the App itself, and may change with App updates.
No account is required for core use of the App; all routines, session data, and settings are stored locally on your device (see the Privacy Policy).
The App and any in-app subscriptions are acquired exclusively through the Apple App Store. The purchase contract for a subscription is formed between you and Apple Distribution International Ltd. (or the applicable Apple entity), not with the Provider. Pricing, billing, invoicing, auto-renewal, cancellation via your Apple ID account settings, and refunds are governed exclusively by the Apple Media Services Terms and Conditions and Apple's own procedures.
Yoga24 Plus subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, via your Apple ID account settings. The Provider has no access to the payment transaction itself and never receives your payment method or billing details (see Privacy Policy, Section 6).
Right of withdrawal / refunds: Because the purchase contract for digital content is formed with Apple, any right of withdrawal is subject to the refund procedures Apple provides (available at reportaproblem.apple.com).
Subject to your compliance with these Terms, the Provider grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use Yoga24 on Apple-branded devices that you own or control, as permitted by the App Store's usage rules.
This is an agreement between you and the Provider only — not with Apple — and Apple is not responsible for the App or its content. Apple has no obligation whatsoever to furnish any maintenance or support services for the App; to the extent any such support is offered, it is provided solely by the Provider via the contact details in Section 14.
To the extent permitted by applicable law, the Provider is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App; to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App. The Provider, not Apple, is solely responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation. In the event of any claim that the App infringes a third party's intellectual property rights, the Provider, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
You represent that you are not located in a country subject to a U.S. Government embargo, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Yoga is a physical activity and carries an inherent risk of injury. Please read this section carefully before using the App.
The Provider's liability is unlimited for intent and gross negligence, and under the mandatory provisions of German product liability law. The Provider's liability for ordinary negligence resulting in injury to life, body, or health is likewise unlimited.
For other damages caused by ordinary negligence, the Provider is liable only for breach of a material contractual obligation (a duty whose fulfillment is essential to the proper performance of this contract and on whose observance you may reasonably rely); in that case, liability is limited to damage that was foreseeable and typical for a contract of this kind at the time it was entered into. Liability for ordinary negligence is otherwise excluded.
These limitations do not apply where the Provider has fraudulently concealed a defect or assumed a guarantee for the quality of the App, or to claims under mandatory product liability law.
When using Yoga24, you agree not to:
All content within the App — including pose illustrations, voice recordings, text, routine compilations, design, icons, and trademarks — is protected by copyright and is owned by, or lawfully licensed to, the Provider. The license granted in Section 4 is limited to personal, non-commercial use of the App; any further reproduction, distribution, or public communication of this content requires the Provider's prior written consent.
The Provider aims to keep the App continuously available and to develop it further, but makes no guarantee of any particular availability, in particular for infrastructure provided by third parties (Apple StoreKit, RevenueCat). The Provider reserves the right to modify, add to, or discontinue features of the App, provided this remains reasonable for users considering their interests.
You may stop using the App at any time by deleting it; cancel an active Yoga24 Plus subscription via your Apple ID account settings (Section 3). The Provider may restrict or suspend access to the App in the event of a serious violation of these Terms, to the extent technically possible through App Store mechanisms.
The Provider may change these Terms with effect for the future — for example, for new features, changed legal requirements, or changed terms of the third-party services the App relies on. We will announce material changes by updating the "Effective Date" above and, where required, by a notice within the App before the change takes effect. Continued use of the App after a change takes effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with your habitual residence in another country, mandatory consumer-protection provisions of that country remain unaffected by this choice of law.
If you are a merchant, a legal entity under public law, or a special public-law fund, Munich, Germany is the exclusive place of jurisdiction for any dispute arising out of or in connection with this relationship.
We are not obligated, and are not willing, to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) within the meaning of § 36 of the German Consumer Dispute Resolution Act (VSBG).
If any provision of these Terms is or becomes invalid, the validity of the remaining provisions is unaffected. The invalid provision will be replaced, to the extent one exists, by the applicable statutory provision.
